Client Agreement
Welcome! Before we begin, it’s important that you fully understand what this program includes and what is expected from both sides to ensure a smooth, supportive, and successful experience.
This section provides a summary of key terms, program expectations, and program details but it does not replace the full Client Agreement that follows. You are responsible for reading the entire Client Agreement in its entirety. This summary is meant to highlight the most important points up front so you feel clear and confident before we begin.
You'll be asked to initial at the bottom of each page and sign at the end of the agreement to confirm that you’ve read, understood, and agree to all terms outlined in the full document. Please review the summary below and the Client Agreement in its entirety:
WHAT YOU CAN EXPECT FROM THIS PROGRAM
You will receive up to 10 consecutive weeks of support, beginning approximately two weeks prior to the start of ovarian stimulation and continuing through your fresh embryo transfer or final embryo update, whichever occurs first within the 10-week window.
If your IVF cycle is delayed, canceled, or rescheduled, the original 10-week support window remains in effect. However, you may continue support beyond this timeframe by enrolling in a monthly extension at a rate of $250/month, which auto-renews and can be canceled at any time with at least 24 hours’ written notice via email.
All purchases are non-refundable. No transfers, exchanges, or partial refunds will be granted under any circumstances, including changes to your medical care, pregnancy, scheduling conflicts, or personal decisions to withdraw.
Included services during the program period:
- One (1) 40-minute onboarding session
- One (1) IVF Prep Call
- Up to three (3) brief IVF strategy check-in calls
- One (1) conclusion call following your embryo update
- Group support sessions (live and/or recorded)
- Private messaging and IVF community access (available to both partners)
- Access to the IVF Resource Vault and Demystifying Your IVF Cycle online course
APPOINTMENTS AND SCHEDULING
- Clients are responsible for booking all sessions using the provided scheduling link.
- Appointments may only be rescheduled once, with a minimum of 24 hours’ notice.
- Missed appointments or cancellations made with less than 24 hours’ notice will result in forfeiture of that session.
- The Consultant will make reasonable efforts to accommodate scheduling requests, but it is the client’s responsibility to remain on track.
MESSAGING SUPPORT
- The private messaging channel (e.g., Slack) is available 24/7 for both partners to submit questions or updates.
- The Consultant will respond Monday through Friday, 9:00 AM – 4:00 PM MST, with a response time of up to 72 hours.
- Messages submitted after 4:00 PM MST or on weekends/holidays will be addressed the next business day.
- Messaging support is intended for the enrolled client and their partner only, and should not be used for inquiries on behalf of family members or for medical emergencies.
ADDITIONAL REMINDERS
- All intake forms and questionnaires must be completed prior to your first session. These are essential for creating a personalized support plan and ensuring that your experience is tailored to your specific needs and goals.
- This is a coaching and educational program. Although the Fertility Consultant holds medical credentials, this program does not include diagnosis, prescriptions, lab ordering, or physical examinations.
- Your REI, OB/Gyn, or primary care physician remains your primary medical provider. The role of your Fertility Consultant is to offer educational insight, emotional support, and strategic planning—not medical care. You are expected to follow your medical provider’s advice first. Any suggestions made in this program should be reviewed with your healthcare team before making any changes to medications, supplements, or treatment plans.
- You must remain under the care of a licensed medical provider (such as a fertility specialist or OB/Gyn) for all physical exams, labs, imaging, prescriptions, and clinical management.
- Communication through platforms like Slack, email, or Zoom is not HIPAA-secure. While we take your privacy seriously, by participating in this program, you acknowledge and accept the risks of using non-encrypted communication tools.
- Results are not guaranteed. This program is designed to provide a high level of personalized support and education, but your success depends on many factors—including your level of engagement, consistency, mindset, and medical circumstances beyond our control.

- AUTHORIZATION OF CONSULTATIONS:
- By purchasing this program, you (the Client) are enrolling in the IVF Support: Coaching + Community Program offered by Fortitude Fertility Consulting, LLC (the Company). This is a high-touch, educational support program that includes strategic guidance, coaching calls, and community access throughout your IVF cycle.
- By purchasing this program, the Client authorizes the Company to provide educational consultations related to fertility, health, mindset, lifestyle, and nutrition. The Client understands and agrees that these services are for educational and supportive purposes only and do not include medical care, diagnosis, or treatment.
- Â NOTICE AS TO THE NATURE OF SERVICES:
- The Company will maintain the highest ethical standards in all client interactions and services provided.
- The Client is solely responsible for their own physical, mental, and emotional well-being, as well as all decisions, actions, and outcomes resulting from participation in the fertility consulting relationship. The Company shall not be held liable for any outcomes, actions, or inactions resulting from the Client’s participation in this program.
- The Client understands that consulting and coaching services are not a form of therapy, do not diagnose or treat mental health conditions, and are not a substitute for professional psychological or medical care.
-  The Client acknowledges that fertility consulting does not involve the diagnosis or treatment of medical conditions, and should not be used as a substitute for counseling, psychotherapy, psychoanalysis, substance abuse treatment, or professional advice from licensed legal, medical, or mental health providers. It is the Client’s sole responsibility to seek independent professional guidance when needed. If the Client is currently under the care of a mental health professional, it is recommended that they inform their provider about their participation in this program.
- Client acknowledges that fertility consulting does not involve the diagnosis or treatment of any medical conditions and should not be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is the Client’s exclusive responsibility to seek such independent professional guidance as needed. If Client is currently under the care of a mental health professional, it is recommended that the Client promptly inform the mental health care provider of the nature and extent of the fertility consulting relationship agreed upon by the Client and the Company.
- The Client understands that the success of this program depends on their active participation. To enhance the fertility consulting relationship, the Client agrees to communicate honestly, remain open to feedback and guidance, and dedicate the time and energy necessary to fully engage with the program.
- The Client also acknowledges that there are many factors beyond the control of both the Client and the Company that may influence fertility outcomes, and that success is not defined by achieving pregnancy, but by gaining clarity, support, and a more empowered approach to the fertility journey.
- TERMS AND SERVICES
- Â The Parties agree to engage in the IVF Support: Coaching + Community program (as outlined below under Schedule and Fees) through telephone, video conference, and asynchronous messaging. This program is designed to provide high-touch, personalized support throughout the IVF process.
- Â Schedule and Fees
-  The Agreement becomes effective on the date of purchase and includes up to 10 weeks of CONSECUTIVE support, beginning approximately two weeks before ovarian stimulation. Support concludes either within one week of the Client’s final embryo update or fresh embryo transfer, whichever occurs first within the 10-week window.
- Â If a delay, cancellation, or medical change causes your IVF cycle to extend beyond the 10-week support window, you may continue with the program by enrolling in a monthly support extension at a rate of $250/month. This grants you continued access to remaining 1:1 services (if applicable), private messaging support, group sessions, and the IVF Support Community until your cycle is complete.
- Â The IVF Support: Coaching + Community program includes the following:
-  One Onboarding Session (40 minutes): This private session will be approximately 40 minutes in duration and conducted over a video conferencing platform. The Comprehensive History + IVF Intake must be completed at least 24-hours before this appointment.
- One 1:1 IVF Prep Call (30 minutes): : This private session will be approximately 30 minutes in duration and conducted over a video conferencing platform. Scheduled before ovarian stimulation begins, this call ensures both partners understand medications, expectations, and how to best prepare.
-  Private Messaging Support and Community Support (for both partners): The Consultant will be available to the Client via direct messaging and within the private IVF Support Community between scheduled sessions. Messages will be responded to within 72 hours during business hours: Monday through Friday, 9:00 AM – 4:00 PM (MST). Please note: Response times may be delayed on holidays, weekends, or during scheduled time off. Clients will be notified in advance of any planned absences.
- Â Three IVF Support Strategy Calls (15 minutes each): There will be up to 3 (three) 15-minute check-in calls conducted over the phone to be scheduled after monitoring appointments during medication administration for the IVF cycle.
- Access to Group Mindset, Education, and Q&A Sessions: Live calls (with replays available) focused on mental health, lifestyle, and understanding your IVF journey—available to both partners.
-  Access to the Resource Vault + IVF Course: You’ll receive access to a private resource library and the Demystifying Your IVF Cycle course for the duration of your support program. Course access ends when the 10-week program concludes.
- Â One Conclusion Call (30 minutes): This private session will be approximately 30 minutes in duration and conducted over a video conferencing platform. This appointment should be scheduled within one week of receiving your final embryo update.
- PAYMENT AND REFUNDS:
- The fee for the IVF Support: Coaching + Community will be displayed at checkout and may vary depending on payment plan or promotional pricing. By completing your purchase, you agree to the pricing terms shown at checkout.
- Credit/debit card payments for your convenience. All payments are processed securely and with the utmost respect for your privacy and security
- All purchases are final and non-refundable. There will be no refunds, transfers, or exchanges of services under any circumstances, including medical changes, cycle cancellation, or withdrawal from the program.
- Enrollment in the program is considered a commitment to participate to the best of your ability.
- In the event that your IVF cycle is canceled, delayed, or rescheduled for any reason after enrollment, the original 10-week support window remains in effect. If additional support is needed beyond this timeframe, you may continue care by enrolling in the monthly extension option ($250/month).
- The monthly extension includes continued access to any remaining 1:1 services (if applicable), private messaging support, group sessions, and the IVF Support Community until your cycle is complete.
- The monthly extension auto-renews each month and may be canceled at any time with a minimum of 24 hours’ written notice via email to the Company prior to the next billing cycle.
- It is the Client’s responsibility to ensure payment information is current.
- No refunds will be issued for charges made due to untimely cancellation.
- CONFIDENTIALITY:
- This fertility consulting relationship, including all information shared by the Client with the Company—whether verbal or documented—is treated as confidential to the fullest extent possible. However, the Client understands that this relationship is not legally privileged (as with attorney-client or physician-patient relationships), and therefore communications are not protected by any legally recognized privilege.
- The Company agrees not to disclose any information pertaining to the Client without the Client’s written consent. The Company will not use the Client’s name as a reference without express permission. Confidential Information does not include information that:
- was in the Company’s possession prior to being furnished by the Client;
- is or becomes publicly available or generally known within the Client’s industry;
- is received from a third party without breach of any obligation to the Client;
- is independently developed by the Company without reference to the Client’s confidential information;
- is required to be disclosed by law, subpoena, or court order;
- is disclosed to the Company and creates a reasonable belief of imminent risk of harm to the Client or others;
- relates to illegal activity.
- The Client acknowledges a continuing obligation to raise any concerns or questions regarding confidentiality with the Company in a timely manner.
- NOTICE THAT THE CONSULTANT IS NOT PROVIDING MEDICAL SERVICES:
- Although consultants within the Company may hold medical credentials, they are not functioning as licensed healthcare providers within the context of this Agreement.
- The Client understands that the Company is not acting as my primary care physician, reproductive endocrinologist, or OB/Gyn, and that this program does not include medical diagnosis, treatment, prescriptions, physical examinations, lab or imaging orders, or emergency care. As such, emergency services are not offered.
- This is a coaching and educational program, designed to offer strategic insight, emotional support, and complementary guidance. While the consultants at the Company may hold medical credentials, services provided through this program are not a substitute for medical care.
- The Client agrees to maintain an ongoing relationship with a licensed medical provider—such as a Reproductive Endocrinologist, OB/Gyn, or primary care physician—for all clinical decision-making, diagnostic testing, prescription management, and physical assessments. The consultants at the Company may provide recommendations for discussion, but any changes to medications, supplements, or treatment plans should first be reviewed and approved by the Client’s medical team.
- The Client acknowledges that services provided are conducted virtually and are not affiliated with a hospital system or emergency response service. The Company does not offer urgent or emergency care, and it is the Client’s responsibility to seek medical attention in the event of a health concern requiring immediate or in-person evaluation.
- NON-HIPAA COMPLIANCE:
- While the Company prioritizes the privacy and confidentiality of the Client, it is important to note that the services provided by the Company do not adhere to the Health Insurance Portability and Accountability Act (HIPAA) regulations. Therefore, the Consultant cannot guarantee the same level of privacy and security as medical providers who are HIPAA compliant.
- USE OF KAJABI PLATFORM:
- We leverage the Kajabi platform to deliver our services, including educational materials, courses, and consultations. Kajabi is a powerful tool that allows us to provide a user-friendly experience, but it's important to note that Kajabi is not a medical platform and does not provide medical services. The Kajabi platform is not HIPAA compliant.
- APPOINTMENTS AND CANCELLATION POLICY:
- The Client is responsible for booking all program sessions using the scheduling link provided by the Company. The Company will notify the Client when it is time to schedule specific calls, but it is the Client’s responsibility to schedule.
- Appointments may only be rescheduled once and must be canceled or rescheduled with a minimum of 24 hours’ notice. Rescheduling requests made less than 24 hours in advance will result in the forfeiture of that session.
- Missed appointments or no-shows without proper notice will not be rescheduled or refunded. The Company reserves the right to enforce this policy in order to maintain fairness and time boundaries for all clients.
- The Company will make reasonable efforts to accommodate scheduling needs. However, it is the Client’s responsibility to manage scheduling and ensure that sessions are completed within the agreed program timeframe.
- MONTHLY EXTENSION SESSIONS AND SCHEDULING
- Clients enrolled in the monthly extension option ($250/month) will continue to have access to messaging support, group sessions, and any remaining 1:1 services not completed during the original 10-week program window.
- All policies outlined in Section 9: Appointments and Cancellation Policy apply to sessions scheduled during the monthly extension period. This includes the requirement to provide at least 24 hours’ notice for cancellations and the one-time-only reschedule allowance per session.
- Monthly extension sessions must be scheduled and used within the month of payment and do not roll over into future months unless explicitly arranged in writing by the Company.
- The Client understands that continued participation in the monthly extension requires proactive scheduling. The Company is not responsible for missed or expired sessions due to the Client’s failure to book within the specified time frame.
- EXCLUSIVITY:
- The Client and the Company acknowledge that this Agreement is not exclusive. The Company reserves the right to enter into similar agreements with other clients and provide services to others during the term of this Agreement.
- INTELLECTUAL PROPERTY:
- All materials provided as part of the Program—including but not limited to copyrighted content, consulting materials, educational resources, videos, and recordings—are the intellectual property of Fortitude Fertility Consulting, LLC.
- The Client agrees not to reproduce, distribute, modify, or share any Program materials without the Company’s prior written consent.
- LIMITATION OF LIABILITY:
- Except as expressly stated in this Agreement, the Company makes no guarantees, representations, or warranties of any kind, express or implied, regarding the results or outcomes of fertility consulting services.
- In no event shall the Company be liable to the Client for indirect, consequential, incidental, or special damages. The Company’s total liability under this Agreement, and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client for services rendered during the current program period only.
- The Client acknowledges full responsibility for their own actions, decisions, and the implementation of any strategies discussed during the Program.
- PERSONAL RESPONSIBILITY:
- The Client understands that the Program is not a substitute for medical advice, diagnosis, or treatment.
- The Client is solely responsible for consulting with their healthcare provider regarding any medical decisions or concerns related to their fertility or overall health
- ENTIRE AGREEMENT:
- This document constitutes the entire agreement between the Client and the Company and reflects a full understanding of the Parties with respect to the subject matter herein. This Agreement supersedes all prior written and verbal agreements.
- This Agreement may be amended or supplemented only by a written document signed by both the Client and the Company.
- DISPUTE RESOLUTION:
- If a dispute arises out of this Agreement that cannot be resolved by mutual consent, the Client and Company agree to attempt to mediate in good faith for up to 30 days after notice given. If the dispute is not so resolved, and in the event of legal action, the prevailing party shall be entitled to recover reasonable attorney’s fees and court costs from the other party.
- SEVERABILITY:
- If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable.
- If a court determines that any part of this Agreement is unenforceable, but would be valid with modification, that provision shall be deemed modified and enforced to the maximum extent permitted by law.
- WAIVER:
- The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement.
- APPLICABLE LAW:
- This Agreement shall be governed and construed in accordance with the laws of the State of Colorado, without giving effect to any conflicts of laws provisions.
- AMENDMENTS:
- Â The Parties agree that any amendments made to this Agreement must be in writing, where they must be signed by both Parties to this Agreement. As such, any amendments made by the Parties will be applied to this Agreement. Oral modifications will not be recognized.
- CLIENT ACKNOWLEDGEMENT:
- The Client certifies that they are engaging in consultation services only, and acknowledges that these services are not a substitute for medical care provided by a licensed healthcare professional. The Client confirms they are participating on their own behalf and do not represent any third party.
- The Client understands that they have the right to review this Agreement with an attorney prior to signing, and confirm that they are entering into this Agreement voluntarily and with full understanding of its provisions.
- The Client acknowledges that the Company is relying on the Client’s signature and agreement to these terms in establishing this contractual relationship.
- By signing this Agreement, the Client acknowledges that some of the guidance offered—whether related to health, fertility, nutrition, or preventative strategies—may be considered innovative, non-traditional, or unconventional. These services are offered solely for educational and informational purposes and should not be interpreted as medical or nutritional advice.
- The Client understands that these services are not covered by insurance and that they are personally responsible for all fees and payments.
- Should collection or legal enforcement become necessary, the Client agrees to pay all associated costs, including reasonable attorney’s fees. The Client further acknowledges that any unpaid balances may be subject to interest at the maximum rate allowed by law.
